Back in May, original Misfits frontman Glenn Danzig sued the band’s bassist Jerry Only for not including him in licensing deals cut with multiple brands to put the band’s “Fiend Logo” on a bunch of different weird objects. Danzig claimed that he created the logo and was entitled to a portion of the profits. Only countersued, saying that Danzig signed away his rights to the logo over two decades ago and that, even if he did have some claim to profits, he was suing well after the six-year statute of limitations for contract disputes. Danzig’s lawsuit has now been dismissed by the court, which said that regardless of Danzig’s input in the creation of the logo, their existing agreement allows Only to make money off of Misfits merchandise without Danzig. “The terms of the provision do not address any obligation regarding trademark registration or negotiations with individual retail merchandisers,” Central District of California Court Judge Gary Klausner said. “Moreover, in reviewing the other provisions contained in the 1994 Agreement, the Court also finds no other terms that govern the parties’ conduct as it pertains to trademarking and licensing.” Looks like this beef has been quashed, at least for now.
