I am in the middle of an 8 hour take home exam for Free Speech, but I’m posting to Scott’s blog anyway. “Why?” you ask. Because it’s the best damn blog the world has seen. And because the 1st Amendment says I can post wherever the fuck I want.
Actually the First Amendment says that “Congress shall make no law…abridging the freedom of speech, or press…” In other words, it serves as a check upon the legislative branch’s constitutionally defined powers and thus is not exactly ‘carte blanche’ for the rest of us to say what we want, when we want, where we want. Indeed, that claim of right is never absolute in the sense that you appear to be defining it, but rather remains subject to both legislative fiat and judicial review. But if that’s what they’re teaching you in Free Speech classes at Harvard Law these days, who am I to disagree?
