Dude, there's a difference between torts and crimes. If he were being charged with a crime, the state of California would prosecute him. He's being sued by another man for damages. This is a civil action. The tort of assault (in some states assault and battery) can include sexual assault. I can't sue another person for a crime, the state decides to prosecute. I can, however, sue them in a court of equity (civil court) for damages.

He's not being charged with crimes by the state, he's being sued in tort for damages. Nothing he did was "illegal," it was just a civil wrong committed by Travolta against the masseurs, allegedly (he probably did it.)
